A former Judge that illegally ruled to favor an in-law of former President Manuel Zelaya, a man by the name of Jesús Kafati and gave Kafati the majority ownership of stock in a major a coffee company in Honduras was convicted of abuse of power yesterday in a unanimous decision made by the three judges that conform the Tribunal de Sentencia of Siguatepeque in Honduras.

The Arcadia Foundation, including founder Robert Carmona-Borjas (seen right) has denounced attributes this as one of many cases we’re still investigating within the region of a newly-reformed Honduras.

El Heraldo yesterday  reported that the Arcadia Foundation has helped set an example to the rest of Latin America and the Caribbean of a Honduras in which the laws are respected.

Unanimously, three judges dictated condemnatory sentences against ex- judge Eleázar Nolasco Zúniga. The conducted oral judgment against the ex- judicial civil servant took place in the Court of Sentence of Siguatepeque, Comayagua.

In the debate hearings they credited criminal responsibility of Nolasco for the crime of abuse of office to the detriment of public administration.

The Court of Sentence was conformed by judges Conan Argueta, Ana Escobar and Victor Cálix, that equates to a February hearing to determine the sentence to Nolasco, that will oscillate from 3 to 6 years of imprisonment.

This sets a historic precedent”, commented the executive vice-president of Arcadia Foundation, Robert Carmona-Borjas, “since in the history of Honduras, a judge has been judged for the first time and condemned by abuse of office”.

According to the sentence, ex- judge Nolasco even committed abuse of office when admitting a demand that was outside his own jurisdiction and in addition realizing an increase in capital to the Society Alimentos S.A., when the Code of Commerce exclusively grants this faculty to the assemblies of each Honduran society, illegally favoring Mr. Jesus Kafati, in-law of ex-president Manuel Zelaya.

The Arcadia Foundation congratulates and values the bravery of the judges, magistrates and public prosecutors who fight against the flagellum of corruption”, said Carmona.
